WITHDRAWAL RIGHTS AND DEADLINES

In accordance with article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods". "The period referred to in the previous paragraph runs from receipt for goods or acceptance of the offer for services.

If the order consists of several products delivered separately, the withdrawal period for all the products concerned by this order runs from the date of receipt of the last product.

Conditions for exercising the right of withdrawal

To exercise his right of withdrawal, the Customer must notify UPWILY SAS of his intention to withdraw, before the expiry of the applicable withdrawal period. In order to do so, the Customer may send an unambiguous statement clearly expressing his/her intention to withdraw, by letter to the following address: UPWILY SAS, 3 Rue Praire, 42000 Saint Etienne, France or by email to the following address: contact@420greenroad.com.

REFUND AND RETURN

The Customer has an additional period of fourteen (14) days from the notification of his intention to withdraw to UPWILY SAS to return the products, at the expense and under the responsibility of the customer, by post to the address provided to him after having contacted UPWILY SAS via the 420greenroad.com website.

UPWILY SAS reserves the right to refuse to process any such return after the expiry of the statutory period of fourteen (14) days from notification by the customer of his decision to withdraw, provided that the expiry of this period without return is attributable to the Customer.

In any event, to be eligible for a refund, products must be returned in their sealed/unopened packaging, accompanied by their purchase invoice or a copy of the invoice.

If the packaging has been opened, UPWILY SAS reserves the right to refuse any return or refund.

The customer, in case of return of ordered product (not used) following a request for retraction, in accordance with the conditions above, will have the choice between opting for a full refund or an exchange of products of the same market value as his order.

If the customer wishes to make a return when part of the products have been used, UPWILY SAS reserves the right to refuse without explanation. In the event that UPWILY SAS accepts the return, the customer may choose between an exchange of the same market value as the basic order minus the value of the used products, or a refund of the value of the returned products.

Regardless of the case, refunds or exchanges will only be made once the returned products have been confirmed as "well received" by UPWILY SAS. In case of loss of package, theft, or other, which would result in a "non-receipt" of products returned by the customer to UPWILY SAS, then UPWILY SAS reserves the right to refuse the refund or exchange previously agreed.

If the return request is due to a fault caused by UPWILY SAS or a non-conformity (see article 12) then the customer will be reimbursed for the totality of the delivery costs (on the basis of the delivery method proposed by UPWILY SAS). If the return request is due to dissatisfaction or other problems unrelated to the services offered by UPWILY SAS, then the return is at the customer's full expense.

In the event that UPWILY SAS confirms a refund in accordance with the above conditions, the refund will be made using the same means of payment used by the customer to pay for the order, without undue delay and no later than fourteen (14) days from the date of receipt by UPWILY SAS of the returned products.

UPWILY SAS will not reimburse any additional costs incurred if the customer has chosen a more expensive delivery method than the one proposed by UPWILY SAS.

REFUNDS AND PACKAGES "NOT RECEIVED" BY THE CUSTOMER

The term "non-received" refers to all cases (excluding customs) that could have resulted in the customer "not receiving" the parcel.

If the package is recorded as "delivered" by the carrier with proof of delivery, but the customer claims not to have received anything, UPWILY SAS reserves the right to refuse any refund.

Metropolitan France :

After 10 working days, in accordance with the conditions set out above, if the customer, having chosen a postal address in Metropolitan France as the delivery address, has still not received his parcel, UPWILY SAS will offer him a full refund of his order or a return of the parcel at no extra cost.

European Union :

After 20 working days, in accordance with the above conditions, if the customer has chosen a delivery address within the European Union (excluding France and French overseas departments and territories) and has still not received his/her parcel, UPWILY SAS will offer a full refund or return of the parcel.

Rest of the world and DOM/TOM :

We do not ship outside the European Union.

Packages seized by customs :

UPWILY SAS reserves the right to refuse any refund, or return of order, in case of seizure by the customs of the country in which the customer is located. We remind you that all products sold on the 420greenroad.com site are in full compliance with the laws in force in France, and that UPWILY SAS, operator of the 420 Green Road brand, cannot be held responsible for the consequences linked to the purchase of products bearing the "420 Green Road" stamp by the courts of a country other than France.
